What Is PERM Actually Certifying?
PERM certification is DOL’s determination that no minimally qualified U.S. worker applied for the job, and that the position’s requirements are legitimate and consistent with what the employer actually needs.
DOL is not certifying that the foreign worker is qualified. They are certifying that the employer conducted a good-faith recruitment effort and found no qualified U.S. applicants. Once certified, the employer can move forward with the I-140 petition to USCIS.
What Are the Recruitment Steps?
The employer must conduct a specific set of recruitment activities before filing. For professional positions, the required steps include:
The additional steps can include job fairs, employer websites, job search websites, on-campus recruiting, trade publications, or employee referral programs, among others.
After recruitment, there is a 30-day waiting period before filing, during which the employer reviews applications and documents why any U.S. applicants were not qualified for the position. That documentation, the recruitment report, is not filed with DOL initially, but must be retained and produced if DOL audits the case.
Why Does PERM Take So Long?
Three reasons.
First, the recruitment process itself takes roughly three to four months before the employer can even file the ETA Form 9089 with DOL. You cannot shortcut the 30-day SWA job order or the 30-day waiting period after recruitment.
Second, DOL processing backlogs are significant. Standard processing, the non-audit track, has run anywhere from 12 to 24 months in recent years. Cases selected for audit can take longer.
Third, errors restart the clock. If DOL audits the case and finds a deficiency in the recruitment documentation, the employer may have to re-recruit and refile. A single mistake, a job ad with the wrong job title, a missing alternate requirements disclosure, can set the case back by 12 to 18 months.
What Triggers a PERM Audit?
DOL audits are not purely random. Certain factors increase the probability: requirements that appear built for to the foreign worker’s resume, wages below the prevailing wage for the occupation and area, positions in high-audit-rate occupations, and employers who have filed many PERM applications.
If your job requirements include a very specific combination of skills and experience that map exactly to the foreign worker’s background but are not standard for the industry, DOL will notice. Requirements must reflect what the job actually needs, not what the employer wants to give the foreign worker a leg up.
Is There a Way to Avoid PERM Entirely?
Yes. Self-petition categories bypass PERM completely. The EB-1A (extraordinary ability) and the EB-2 National Interest Waiver both let qualified individuals petition for themselves, without an employer and without DOL certification.
Not everyone qualifies for these categories, the evidentiary standards are real. But for professionals with strong credentials, significant publications or business track records, or work in areas of national importance, a self-petition is worth evaluating before committing a year or more to the PERM process.
